Software License Agreement

Limited Warranty

This product is provided “as is” without warranty of any kind. The entire risk as to the results and performance of the program is assumed by you. Should the program prove defective, you (and not RelationshipSecure or it’s dealers) assume the entire cost of all necessary servicing, repair or correction. Further, RelationshipSecure does not warrant, guarantee, or make representations regarding the use of, or the results of the use of this program in terms of correctness, accuracy, reliability, currentness, or otherwise, and you rely on the program and its results solely at your own risk. RelationshipSecure cannot accept responsibility for system damage, loss of profit, or any other special, incidental or consequential damage resulting from the use or inability to use this product. RelationshipSecure DOES warrant that for a period of ninety (90) days from the purchase of the PROFESSIONAL version of the software hereunder each unmodified copy of the software will conform substantially to the product description on our website at www.RelationshipSecure.com . RelationshipSecure’s entire liability and your exclusive remedy with respect to this warranty shall be RelationshipSecure using commercially reasonable efforts to correct such non-conformities.

License

This software is licensed, NOT sold, according to the following legal agreement between you (the end user) and RelationshipSecure. By installing this software, you are agreeing to be bound by the terms set forth in this agreement. If you do not agree to the terms of this agreement, then please exit the installation program now without installing the software. The following agreement shall be governed by the laws of the State of New York.

1. Grant of License: RelationshipSecure grants you the right to use one copy of the software program (the “Software”) on a single computer.

2. Copyright/Trademark: The software is owned by RelationshipSecure and is protected by United States copyright laws (© 2003 RelationshipSecure) and international treaty provisions. Accordingly, you must treat the Software like any other copyrighted material except that you may transfer the software to a disk provided it is used solely for archival or backup purposes. RelationshipSecure is a trademark of the RelationshipSecure division of Hire Resumes, Inc.

3. Confidentiality: The Software and related documentation represent confidential information and trade secrets of the Licensor, which You agree to keep confidential and not disclose to any third party.

4. Other restrictions: You may not rent or lease the Software. You may not assign this agreement or any portion thereof, or any rights hereunder without the prior written consent of RelationshipSecure. You may not reverse engineer, decompile, or disassemble the Software. You may not use the Software for any activity which is contrary to the law in any jurisdiction, including without limitation, activities such as spamming or collection of personal information for purposes other than as permitted by law. You may not modify or adapt or creative derivative works based on any part of the Software. All further acquired Software materials from RelationshipSecure will be bound by this agreement.

5. Severability: The Terms are severable and may be construed to the extent of their enforceability in light of the parties’ mutual intent if deemed at all unenforceable by a competent court.
U.S. Government Restricted Rights

The Software and documentation are provided with RESTRICTED RIGHTS. Use, duplication or disclosure by the Government is subject to restrictions set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at 52.227-7013.
